Acceptance of Terms

By installing and using CardVenture (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

Description of Service

CardVenture includes an iOS app for creating and delivering personalized virtual gifts, a browser-based recipient experience, group gifting, and tools for participating Shopify merchants. A CardVenture experience may include an optional third-party gift card supplied by the sender; CardVenture does not issue or guarantee that stored-value card.

Consumer Purchases and Coins

Purchases in the iOS app are processed by Apple. CardVenture coins are a limited, non-transferable license to unlock eligible digital creation features; they have no cash value and cannot be redeemed or transferred. You receive a free preview before an eligible AI gift is unlocked. Refund requests for Apple in-app purchases are handled under Apple's refund process and applicable law.

User Content and Safety

You retain ownership of photos, recordings, messages, and other material you submit. You grant CardVenture and its processing providers a limited license to host, transform, generate from, and deliver that material solely to operate the Service. You must have permission to use submitted content and contact details. Do not submit illegal, threatening, hateful, sexually exploitative, infringing, deceptive, or privacy-invasive content. We may remove content, limit delivery, suspend access, and preserve evidence when reasonably necessary for safety, legal compliance, or fraud prevention. Recipients can report content and block future messages from a sender.

Merchant Responsibilities

• You are responsible for the gift card products you sell and the accuracy of pricing
• You must comply with all applicable laws regarding gift cards in your jurisdiction
• You are responsible for obtaining consent from gift card recipients for delivery communications
• You must not use the Service for fraudulent, illegal, or harmful purposes

AI-Generated Content

CardVenture uses artificial intelligence to generate personalized content including stories, images, and interactive elements. AI-generated content is provided “as is” and may occasionally produce unexpected results. CardVenture is not liable for the content generated by AI systems.

Billing & Subscriptions

Shopify merchant subscriptions use Shopify's managed billing system and may be cancelled through Shopify. iOS consumer purchases use Apple's in-app purchase system. The billing platform's applicable refund and cancellation rules govern each transaction, subject to non-waivable consumer law.

Intellectual Property

CardVenture's platform, experiences, and design are proprietary. Custom experiences built for your store are licensed exclusively to you. Your brand assets (logo, colors, name) remain your property and are used solely for delivering branded experiences to your customers.

Limitation of Liability

CardVenture is not liable for delivery failures caused by incorrect recipient information, email provider blocking, or third-party service outages. Our maximum liability is limited to the fees paid for the Service in the preceding 12 months.

Termination

Either party may terminate the Service at any time. Upon uninstallation, CardVenture will delete merchant data within 48 hours as described in our Privacy Policy. Gift card codes already delivered to recipients will continue to function through Shopify's native gift card system.
